Terms of Use

These Terms of Use ("Terms") govern your use of makeascenephotos.com. That includes our online proposals, booking, signing, and payment pages, and our Digital Lookbooks (together, the "Site"). The Site is operated by Coastal Bay Digital LLC d/b/a Make a Scene Photo Company ("Make a Scene Photo Co.," "we," "us," or "our"), a Delaware limited liability company.

By using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

If you book our photo booth services, your signed Photo Booth Services Agreement (the "Agreement") governs those services. If these Terms and your Agreement conflict, your Agreement controls.

1. Using the Site

1.1 Eligibility.

• You must be at least 18 years old to request a proposal or book services.
• Guests of any age may view a Lookbook they've been given access to. Children should do so with a parent's or guardian's permission.

1.2 Acceptable use. You agree not to:

• use the Site in any unlawful, fraudulent, or harmful way;
• interfere with the Site's operation or security, including by probing, scanning, or testing for vulnerabilities;
• access or try to access any proposal, booking, signing page, or Lookbook that wasn't shared with you, including by guessing, generating, or collecting links;
• use bots, scrapers, or other automated tools to access or copy the Site or its content;
• impersonate anyone, or give us false information;
• upload or transmit malware or other harmful code.

2. Online booking, quotes & proposals

2.1 General information. Packages, prices, and availability on the Site are general information. Checking a date online doesn't reserve it.

2.2 Proposals are offers.

• A quote or proposal is an offer, and we may change or withdraw it until you accept it.
• A proposal expires on the date it shows, or 14 days after we send it if it shows no date.

2.3 When your booking is confirmed. Your booking is confirmed only when both of these have happened:

• you and we have both signed the Agreement; and
• we've received your Retainer.

2.4 The Agreement controls. Your signed Agreement sets out the terms for your event, including payments, cancellations, rescheduling, and photo licensing. Nothing in these Terms changes it.

3. Pricing & payments

3.1 Prices.

• Prices on the Site may change at any time until your Agreement is signed.
• Once your Agreement is signed, your prices are locked as stated in it.

3.2 Errors.

• We may correct pricing or typographical errors on the Site or in a proposal at any time before your booking is confirmed.
• If an error affects a booking you've already confirmed, we'll contact you before charging anything more. If you don't agree to the corrected price, you may cancel and receive a full refund.

3.3 Travel and taxes.

• Travel is free within 40 driving miles of our base in Sussex County, Delaware. Beyond that distance, zone-based travel fees of $80, $160, or $265 apply, as quoted in your proposal.
• Applicable taxes, if any, are added as described in your Agreement.

3.4 Payment methods and card fee.

• No fee: bank (ACH) payments, cash, and checks.
• Cards (credit or debit): a 3% card fee on the amount you pay by card.
• You'll see the exact fee before you pay, and it appears as a separate line on your receipt.

3.5 Payment processing. Payments are processed by Stripe. Stripe's terms and privacy policy may also apply to your payment.

4. Your links & security

• Keep your links private. The proposal, signing, booking, and payment links we email you are meant for you. Please don't forward them.
• Your responsibility. You're responsible for activity that happens through links we send to you.
• If a link is compromised. Tell us right away at hello@makeascenephotos.com if you think one has been shared without your permission. We may disable a link and send you a new one.

5. Intellectual property

5.1 Our content.

• The Site and its content belong to us or our licensors. That includes text, graphics, logos, designs, photos, and software.
• "Make a Scene Photo Co." and our logos are our trademarks.

5.2 What you may do with it.

• You may use the Site to learn about and book our services, for yourself or for your organization's event.
• Unless we give you written permission, you may not copy, modify, distribute, or create works from our content, except for normal browser caching and printing of pages for personal reference.

5.3 Event Photos.

• We own the copyright in the photos our booth captures ("Event Photos").
• Clients: your license is described in your Agreement.
• Guests: for any Lookbook shared with you, we grant you a personal, non-commercial license to view, download, print, and share the Event Photos you appear in or receive (for example, on your personal social media), subject to Section 6.

6. Digital Lookbook acceptable use

Lookbooks are made for celebrating, so please treat them, and the people in them, with respect. When you use a Lookbook, you agree to these rules:

• Personal, non-commercial use only. Don't sell or license Event Photos, or use them in advertising or for any commercial purpose, without our written permission. You'd also need the permission of the people shown.
• Respect the people pictured. Don't use Event Photos to harass, bully, shame, defame, sexualize, or exploit anyone, or in a way that violates anyone's privacy or publicity rights.
• No identification or training uses.
  • Don't use Event Photos to identify people through facial recognition.
  • Don't use them to build biometric or face databases.
  • Don't use them to train artificial-intelligence or machine-learning models.
• No scraping or snooping. Don't bulk-download Lookbooks you weren't given, and don't try to find other Lookbooks.
• Leave credits in place. Don't remove watermarks or credits we add.
• The host is in charge. The event host decides who receives the Lookbook link, and may hide photos at any time.
• Removal requests. Anyone who appears in a photo can ask us to remove it. Email hello@makeascenephotos.com with the Lookbook link and a description of the photo. See our Privacy Policy for details.

7. What you send us

7.1 Your submissions. When you send us inquiries, messages, logos, artwork, or other content:

• you confirm you have the right to share them;
• you permit us to use them to respond to you and to provide our services.

7.2 Sensitive information. Please don't send us sensitive information we don't need, such as Social Security numbers, or full card or bank numbers by email.

8. Third-party services & links

• Our providers. The Site relies on third-party services, such as Stripe for payments, and may link to other websites.
• Their terms. We aren't responsible for third-party sites or services, and their own terms and privacy policies apply.

9. Disclaimers

• "As is." We work hard to keep the Site and Lookbooks accurate, secure, and available. To the fullest extent permitted by law, however, they're provided "as is" and "as available," without warranties of any kind, whether express or implied. That includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Availability. We don't guarantee that the Site will be uninterrupted or error-free. We intend to keep Lookbooks online long-term, as described in the Agreement and our Privacy Policy. Even so, please download and keep your own copies of the photos that matter to you.
• Services. Warranties and remedies for event services are set out in your Agreement.

10. Limitation of liability

• Scope. This Section applies to your use of the Site and Lookbooks. Our event services are governed by your Agreement.
• No indirect damages. We aren't liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Lookbooks.
• Cap. Our total liability for any claim related to your use of the Site or Lookbooks is limited to $100.
• Exceptions. This Section doesn't limit liability for gross negligence, willful misconduct, or fraud, or any liability that cannot be limited by law.

11. Your responsibility for misuse

If you use the Site, a Lookbook, or Event Photos in violation of these Terms, you're responsible for resulting claims by third parties against us. That includes reasonable attorneys' fees and costs.

12. Takedowns & copyright concerns

If you believe something on the Site infringes your rights, or a photo should be removed for another reason, email hello@makeascenephotos.com with:

• the link;
• a description of the content;
• why it should be removed;
• how to reach you.

We'll review your request promptly and respond.

13. Changes & termination

• Changes to these Terms. We may update these Terms from time to time. We'll post the updated Terms here with a new effective date. Changes don't affect an Agreement you've already signed.
• Suspension. We may suspend or end access to the Site, a link, or a Lookbook for anyone who violates these Terms. For a client's Lookbook, we'll first contact the host when practical.

14. Governing law & venue

• Governing law. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.
• Talk to us first. If a dispute arises, please contact us first, and we'll try in good faith to resolve it informally within 30 days.
• Courts. Any lawsuit about these Terms or the Site must be brought in the state courts located in Sussex County, Delaware, and you and we consent to those courts' jurisdiction. Either of us may bring an eligible claim in the Justice of the Peace Court in Sussex County.

15. General

• Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Site. Your Agreement governs our services.
• Severability. If any part of these Terms is unenforceable, the rest stays in effect.
• No waiver. Not enforcing a provision isn't a waiver of it.
• Assignment. We may transfer these Terms to a successor to our business.
